最近廣州高級人民法院對一起鄰居不讓裝電梯案件進行了裁定,已獲得專有部分占建筑物總面積三分之二以上,且占總?cè)藬?shù)三分之二以上的業(yè)主同意,并有廣州市規(guī)劃局核發(fā)的《建筑工程規(guī)劃許可》,符合法律規(guī)定,因此而簽訂施工合同受法律保護,相鄰各方業(yè)主不能擅自阻撓安裝施工。至此一宗糾纏了6年的老宅加裝電梯糾紛終于有了最終的結(jié)果。
在加裝過程中,由于加裝電梯擋鄰居室內(nèi)采光、護欄、空調(diào)位置與加裝電梯沖突等,鄰里會產(chǎn)生糾紛。不過最終法官裁定少數(shù)服務(wù)從多數(shù)。法院認為,根據(jù)我國法律關(guān)于相鄰權(quán)的規(guī)定,涉案樓宇加裝電梯,雖然對被告房屋的采光通風產(chǎn)生一定影響,但對包括被告在內(nèi)的眾業(yè)主特別是老人小孩帶來極大便利;被告本人同樣被惠及,應(yīng)本著友睦鄰里、互讓互諒的精神對待加裝電梯工程,而不能擅自采取各種行動,阻撓安裝施工。

Superior People’s Court of Guangzhou held a decision in a case where an inhabitant sued its neighbor for not allowing him install elevator that with the agreement of 2/3 of the proprietors and conformance with the regulations released by municipal Planning Department, the construction contract is protected by the law. Any neighbor is not allowed to hinder the work. The lawsuit lasting for 6 years has after all come to an end.
